Terms of Service

These Terms govern your access to and use of the MVP Generation Engine API and website (the "Service"), operated by Truth J Blue ("Truth J Blue," "we," "us"). By creating an account or making any API request, you agree to these Terms.

• You are responsible for safeguarding your API keys. Treat them as you would a database password. Compromised keys can be revoked from the dashboard.
• You are responsible for all activity that occurs under your account or any API key issued to your account.
• You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
• You must provide an accurate email and keep it current so we can reach you about billing and security.

You agree not to use the Service to:

• Generate content that is illegal, defamatory, harassing, or that infringes a third party's intellectual property.
• Generate content depicting minors in sexual or violent contexts, or any content prohibited by OpenAI's usage policies.
• Generate spam, phishing material, or impersonation content.
• Reverse-engineer, scrape, or attempt to bypass our rate limits, billing meter, or authentication layer.
• Resell raw API access to third parties without prior written agreement (using the API to deliver client work is permitted and expected — that's the product).
• Use the Service for any purpose that violates applicable law.

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice depending on severity.

• Subscription tiers, included quotas, and overage rates are published at /pricing and may change with at least 30 days' notice to existing paid customers.
• Monthly and Annual subscriptions auto-renew until canceled. You can cancel at any time from the Stripe customer portal accessible from your dashboard.
• Per-generation overage is billed monthly in arrears via Stripe's usage-based metering.
• Failed payments place your account in past_due status; new generations are blocked until payment succeeds. After 14 days unresolved, the account is canceled.
• Refund eligibility is governed by our Refund Policy.

You own what you generate. You retain all ownership of the intake you submit and the assets we produce from it. You grant us a limited, non-exclusive license to process your intake through our pipeline, store the resulting assets in your account, and deliver them to a webhook URL you configure.

We do not use your intake or generated assets to train models. We do not share them with third parties except the sub-processors strictly required to deliver the Service (see Privacy Policy).

We aim to maintain high availability but do not guarantee uninterrupted service. We may schedule maintenance windows, apply security patches, and make compatible API changes without individual notice. Breaking API changes will be announced at least 30 days in advance and tagged in the public changelog.

Generated assets are produced by large language models and may contain factual errors, dated information, or stylistic inconsistencies. The output is not legal, financial, medical, or other professional advice. You are responsible for reviewing and editing assets before using them with clients or in public-facing materials.

You may cancel your subscription at any time via the Stripe customer portal. We may terminate or suspend your account if you materially breach these Terms or fail to pay. Upon termination, your access ends and your data is handled per the Privacy Policy retention schedule.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TRUTH J BLUE'S TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES.

You agree to indemnify and hold Truth J Blue harmless from any third-party claim arising out of your use of the Service in violation of these Terms, including any claim that content you generated or published infringes a third party's rights.
